Understanding Notary Fee Limits
A notary public is a state-appointed official who verifies signatures and administers oaths. Most states set a maximum fee a notary can charge — overcharging is a violation that can result in loss of commission.
Fees vary dramatically by state: New York caps acknowledgments at $2, while Rhode Island allows $25 per act. About 10 states set no maximum fee, leaving pricing to the notary's discretion.
Types of Notarial Acts
- Acknowledgment: The signer appears before the notary and acknowledges they signed the document voluntarily. Used for deeds, mortgages, and powers of attorney.
- Jurat: The signer swears or affirms that the document's contents are true. Used for affidavits and sworn statements.
- Oath / Affirmation: A verbal pledge of truthfulness, without a document signature. Used in legal proceedings.
- Remote Online Notarization (RON): A notarization performed via live audio-video technology. Available in 33 states, typically at a higher fee ($25–$30).
Travel Fees
Most states allow mobile notaries to charge travel fees in addition to the per-act fee. Some states set a maximum mileage rate; others simply require advance disclosure. Always ask about travel fees before booking a mobile notary.
